ANALYZING THE FAKE DMCA

DMCA as fake as they come, perhaps as fake as Buildteam’s reputation is in Clapham.

Let’s analyze the DMCA notices –

Build Team, Clapham

Build Team, Clapham

The DMCA filed by one ‘Douglas Bush’ on 21st April 2016 claimed that the ‘reviews’ originally published on gotohomestay.com was copy-pasted on a forum. Rather suspicious claim, as we shall see below –

Build Team, Clapham

Unfortunately, the website gotohomestay.com was not active until 22nd March 2016, which implies that the original content was NOT present on that website on December 2015 when it claimed it was published.

Ironically, the website was launched just a week prior to filing the fake DMCAs.

The website was registered in the name of –

Registrant Name: Muhammad Ashraf
Registrant City: Faisalabad
Registrant State/Province: Punjab
Registrant Postal Code: 38000
Registrant Country: PK
Registrant Phone: +92.3346547714
Registrant Email: [email protected]

This is the same miscreant who is behind the fake DMCAs filed for Wagner Trucking and Upfront Consultations –

We are not the first ones to notice this. The Guardian ran a story on this incident here.

Unfortunately, mumsnet.com was forced to delete the thread, but Webactivism will be publishing the entire copy on multiple platforms now.

The attempt at fake DMCA was so obviously bad, that the original publisher of the review on mumsnet filed a counter notice to reinstate the page on Google search – https://www.lumendatabase.org/notices/12159803

Here is what the original poster had to say about the fake DMCA –

This is an original review that I posted on the 26th of December. The claim that it was previously posted on the website as stated is something that I believe to be false and possibly a tactic created in order to create legitimate cause to remove the discussion thread from the Google search engine. My review is original and genuine. I strongly dispute the authenticity of this claim and seek to have the thread reinstated into Google search in the interest of the freedom of public information I invite a full inquiry into this accusation of copyright infringement.

SO WHAT WERE THEY TRYING TO HIDE ?

Here are a few posts from the thread Buildteam.com tried to hide. See for yourself –

Hello world. Has anyone else used this company?
I am seeking others who may have had issues similar to the ones we have experienced in order to convince me that it wasn’t all just our bad luck.
We are in recovery (and may need therapy) from using Buildteam’s services. A truly ghastly experience which has included: delays, empty promises, appalling customer service, hidden costs, serious disinterest in quality, non English speaking workforce, major building errors, staff changes, some dishonesty, absent project management etc.
The list goes on and on.
Given our experience, their shiny website now reads like an imaginative comedy script detailing all the things we didn’t get. I have a huge file (think dossier) of documented evidence, including video, which provides examples of how we didn’t. Blog, book, TV series and movie to follow. Maybe.
Who are all these happy customers? Why aren’t I one of them?
If you are thinking of a side return I am happy to share details so you can make your own mind up but if you want my advice, don’t go there.

Do not use this firm. Quality of work is poor and they do not project manage the build other than for invoicing gateways.

unfortunately not. And unfortunately, unless you are a qualified builder and construction PM yourself, you do not realise the poor quality of finishing until it is finished.

Will not be commenting much more though as we have contacted FMB and will be pursuing the arbitration route. Which will cause more disruption to the family and prolong our inability to “Live” in house…

I would just stress “do not use”

It’s been a long time but, having just come across their name again, I just wanted to re-iterate just what an awful company Build Team was to us – all aspects of work shoddy, zero control of subcontractors, highly defensive and aggressive staff, only good at issuing invoices and a complete absence of any concern or care for customers. Proceed at your own peril.

Build Team (Holborn) Ltd (and their sister company Design Team Holborn Ltd) were not adequately insured to either design or build our project. If you are thinking of instructing them – or if they have done work for you – ask to see their public liability and professional indemnity insurance.

Do not use this firm. Quality of work is poor and they do not project manage the build other than for invoicing gateways.

WHAT IS A FAKE DMCA AND WHY ARE WE LISTED HERE ?

In case you are one of the ‘beneficiaries’  listed in this report and are wondering what really happened, we suggest you look within. If it wasn’t you, or your associates, it is definitely the ‘Reputation’ or ‘SEO’ firm you have hired in the past. Perhaps even your law firm. So, instead of blaming us for this article, you must grill your Reputation/SEO firm and look for answers. We are merely publishing the facts available on public database and have nothing against you personally. It is more than likely that the service you hired indulged in criminal methods to deliver results for you.

Meanwhile, we are awaiting more information from Mumsnet and Google to ascertain who was behind this fake DMCA. We’ll update this page once we have more information. If you have any information to add to this investigation, get in touch with us at [email protected]

Soon after we published the first set of our investigation reports on fake DMCAs, we managed to generate interest from online media such as Techdirt, Adweek and Huffington Post. Some of the key stories included our revelations on Torrence Boone , MoneyLife.in, Julia Scelfo and aReputation. We also shared unpublished data and information with 3 different law agencies who looked into this scam.

And we got results. We dented this fake DMCA industry and made sure we act as deterrent to the rogue reputation firms indulged in these criminal practices. Here are some of the outcomes and changes we made possible with the help of several other citizen lawyers and agencies –

Fake Fraudulent DMCA might seem inconspicuous, until its you at the receiving end of this crime. This is not a prank. This is not an inconvenience. This is not random. These fake DMCA cases are calculated criminal schemes targeting very specific and rather important information/content. These hitjobs are usually against media, in order to help their clients hide important information from public’s eye, all in the name of Reputation Management. Millions of dollars are spent doing this, and if no one wants to bring this topic to the fore, we will.

Our team will not constantly monitor and publish these reports on a DAILY basis without fail. And we do not plan to publish and forget. We will take constructive steps in order to expose the faces behind this scam, and to try and undo the damages. AND IF YOU INDEED PART OF THIS SCAM, WE WILL ENSURE THAT YOU GET WHAT’S COMING YOUR WAY.
